Former Federal Prosecutor: Neither Impeachment Charge Is a High Crime or Misdemeanor


While joining Fox News' "America's Newsroom" on Tuesday, former federal prosecutor Robert Ray reacted to the House Democrats' articles of impeachment announcement against President Trump, saying that neither charge is impeachable.

On Tuesday, House Democrats led by Speaker of the House Nancy Pelosi announced that they were filing articles of impeachment against President Donald Trump, accusing him of "obstructing Congress" and "abuse of power."

According to Ray however, neither charge is impeachable.

"My first reaction to that is despite what you just heard from Chairman Nadler, neither one of those is a high crime or misdemeanor," Ray asserted. "So we have not passed through an investigation over the course of the last several months where it’s not treason, it’s not bribery, it’s not extortion, it’s not a foreign an illegal foreign campaign violation it’s now whatever a majority of the House of Representatives that is controlled by the Democrats say it is, which is abuse of power, abuse of conduct and an inter-branch dispute."

This impeachment announcement by House Democrats once again proves that they will impeach the President even if no crime was committed.

“The framers of the Constitution prescribed a clear remedy for presidents who so violate their oath of office,” said House Judiciary Committee Chairman Jerry Nadler. "No one, not even the president, is above the law.”

"Trump has engaged in unprecedented, categorical, and indiscriminate defiance of the impeachment inquiry," Nadler added.

House Intelligence Committee Chairman Adam Schiff said that the President left him "no choice."

"He has given us no choice," Schiff said. "To do nothing would make ourselves complicit in the president's abuse of his high office."

Shortly after the announcement was made, President Donald Trump punched back on Twitter saying, "WITCH HUNT!" This is the same term that he used for the Democrat Russian collusion conspiracy theory.

"Nadler just said that I 'pressured Ukraine to interfere in our 2020 Election.' Ridiculous, and he knows that is not true. Both the President & Foreign Minister of Ukraine said, many times, that there 'WAS NO PRESSURE.' Nadler and the Dems know this, but refuse to acknowledge!" Trump tweeted.

White House Press Secretary Stephanie Grisham also hammered the Democrats after their announcement was made, saying that their actions are to "overturn the votes" of the American people.

"Today, in a baseless and partisan attempt to undermine a sitting President, Speaker Pelosi and House Democrats announced the pre-determined outcome of their sham impeachment – something they have been seeking since before President Trump was inaugurated," she said in the statement.

Absent from the planned charges is a “bribery” count, which Democrats have repeatedly accused the president of in regards to his highly controversial July 25 phone call with Ukrainian President Volodymyr Zelensky -- in which he pressured him to launch an investigation into former Vice President Joe Biden and his son Hunter’s dealings with Ukraine.

Pelosi held a meeting in her office Monday night with Nadler, Schiff, Foreign Affairs Committee Chairman Eliot Engel, D-N.Y., and Oversight Committee Chair Carolyn Maloney, D-N.Y., after a hearing held by Nadler’s committee that featured lawyers laying out the evidence for and against impeachment.

In drafting the articles of impeachment, Pelosi is facing a legal and political challenge of balancing the views of her majority while hitting the Constitution's high bar of "treason, bribery or other high crimes and misdemeanors."
