The Missouri Attorney General Eric Schmidt, a Republican Senate candidate announced a suit on Thursday alongside Louisiana attorney general Jeff Landry. The lawsuit is against key players in the Biden administration for colluding with tech media giants like Facebook, Twitter, YouTube, and others to suppress and censor free speech, including factual information, in regard to COVID-19, the election integrity, and other topics under the guise of combating “miss information” a press release from Eric Schmidt’s office placed on his website May 5th, 2022.
“Freedom of speech is paramount to a healthy society and discourse, debate, and discussion have been the cornerstone of our country since the Founders codified that right in the Bill of Rights. Missourians and Americans use social media platforms, which are now ubiquitous in our modern society, to discuss topics like the efficacy of masks and the veracity of the lab-leak theory. In direct contravention to the First Amendment and freedom of speech, the Biden Administration has been engaged in a pernicious campaign to both pressure social media giants to censor and suppress speech and work directly with those platforms to achieve that censorship in a misguided and Orwellian campaign against ‘misinformation,’” said Attorney General Schmitt. “In the lawsuit that Missouri and Louisiana filed today, we allege that government officials in the Biden Administration, including President Biden, Press Secretary Jen Psaki, Dr. Anthony Fauci, Surgeon General Vivek Murthy, and others colluded with social media companies like Meta, Twitter, and Youtube to remove truthful information related to the lab-leak theory, the efficacy of masks, election integrity, and more. I will not stand idly by while the Biden Administration attempts to trample on the First Amendment rights of Missourians and Americans.”
The lawsuit filed demonstrates that the Biden administration has been colluding with big tech companies to censor Americans free speech and continues too today. It goes on to show that this is a threat to our republic as it shows how Biden on the campaign trail, and now in official capacity, were directly working with employees of big tech to sensor free speech. This would be in direct violation of several Supreme Court lawsuits which state a private entity violates the First Amendment if the government coerces or induces it to take an action the government itself would not be allowed to do, such as censor the expression of legal speech. Ironically, this is from Biden versus the Knight First Amendment institute of Columbia University a lawsuit in 2021.
The lawsuit lists at least five reasons why it is considered a government action which will be summed up briefly here through section 230 of the Communications Decency Act and other actions. The government coerced a small number of large social media companies with a disproportionate ability to censor and suppress free speech based on the speaker’s point of view, to suppress certain topics for legal benefits, such as the absence of antitrust enforcement. This means that they benefited from doing the bidding of federal officials to violate the First Amendment of American citizens.
